Introduction

This Privacy Policy explains the types of information the nonprofit Worthy Mentoring (“Organization”, “we”, “our”, or “us”) collects about you, how we use that information, the purposes for which we use that information, the parties with whom we may share that information, and your choices regarding our use of that information.  For purposes of this Privacy Policy, “personal information” means any information that relates to you as an individual and could reasonably be used to identify you.  These practices relate to information collected by us on our website, worthymentoring.org, through our mobile iOS and Android application (the website and the applications, together, the “Website”), or in email or other electronic messages between you and the Website (the “Communications”). Together, the Website and the Communications are the “Services”.  To the extent permitted by applicable law, your use of the Services constitutes your acknowledgement and/or consent to the practices described in this Privacy Policy. Please read this Privacy Policy carefully.

Our privacy practices may change.  Any such changes will be reflected in our Privacy Policy, which will be accessible on the Website.  We will notify you about changes that significantly impact our use of your personal information by placing a prominent notice on the Website or by sending you an email.  You are not required to provide all of the information described below.  However, to the extent permitted by applicable law, your continued use of the Services after we post any changes to this Privacy Policy signifies your understanding and acceptance of the updated terms of the Privacy Policy, so please ensure that you check the Privacy Policy periodically for updates.  For the avoidance of doubt, disputes arising as considered in this document will be resolved in accordance with the Privacy Policy in effect at the time the dispute arose.

Our Terms of Use incorporates this Privacy Policy (collectively, the “Terms”) by reference.  Capitalized terms that are not defined in the Privacy Policy have the meaning given to them in the Terms of Use.

1.  Information We Collect About You and How We Collect It

In providing the Services to you and helping you develop meaningful connections with Worthy Mentors and Worthy Mentees, we may collect information about you in several ways, including, without limitation, through your correspondence if you contact us, automatically as you navigate through the Services, and directly from you when you provide it to us either offline or on these Services, such as through the Website.

The information we collect includes:

·       Personal Information You Give To Us Directly

o   Worthy Mentors and Worthy Mentees. When you submit the Worthy Mentor/Worthy Mentee profile form, the form asks you to provide us with your name, username, password, email address, gender identity, sexual orientation, date of birth, ethnicity, state of residence, languages spoken, and what you’re looking for in a Worthy Mentor or Worthy Mentee.  Because of the nature of the services we provide, in order to use and participate in the Services, we require you to provide us with your name, username, state of residence, sexual orientation, languages spoken, email address, and password.

If you apply to be a Worthy Mentor, the form asks you to provide your name, date of birth, phone number, address, social media handle, why you would like to be a Worthy Mentor (including, without limitation, your goals and what you would like to offer our Worthy Mentees), military experience, athletic experience, professional field, religion, and anything else you’d like to share.  We require you to provide your name, date of birth, phone number, goals as a Worthy Mentor, and how you could benefit your Worthy Mentee.

As part of the application form, you can also share additional information with us, such as topics you’d like to discuss with a Worthy Mentor or Worthy Mentee or any other details about you, such as your personality, lifestyle, and interests.  If you contact us for help, we collect the information you give us as part of the interaction.

o   Donations. If you would like to donate to us, we ask you to provide your email address, amount of your contribution, payment card information, the name of the person you may like to make your donation in honor of, whether you want that individual to be notified of your contribution, and if so, that individual’s email address and the message you would like to send.  We utilize the services of Stripe and GiveButter to handle your donations and donation information. Please note that while Stripe and GiveButter process your payment card information (and we do not), we may gain access to certain information about your method of payment, such as your name, email address, billing address, and the last four (4) digits of your payment card.

o   Website Visitors. Personal information is also generally collected through use of the Website, such as submission through the “Contact Us” page.  Personal information collected through such use of the Website includes, but is not limited to, names and email addresses.

·       Automatically Collected Personal Information When You Use Our Services.  Automatically collected personal information we collect about you may include the internet protocol (IP) address of the computer you are using, the browser and operating system that you use, the date and time you access the Services, information about how you navigate the Services (frequency, time, where you click, etc.), and other information.  The Services may utilize web beacons, embedded scripts, mobile device identifiers, or similar technologies that automatically collect such information about you.  Automatically collected personal information we collect about you may also include information collected via one or more “cookies” when you visit our Website.  Cookies are small text files that are stored on browsers or devices by websites, apps, online media, and advertisements.  We use cookies and similar technologies for purposes such as remembering user preferences and settings, determining the popularity of content, delivering and measuring the effectiveness of advertising campaigns, and analyzing traffic to our Website.  You may be able to decline our cookies through your browser settings; however, this may interfere with your ability to use our Website or certain features in our Website.  We may also use Google Analytics or a similar service that uses cookies to help us analyze how users use the Services we provide to you.  Currently, various browsers offer a “Do Not Track” option, but there is no standard for how “Do Not Track” should work on commercial websites. Due to the lack of such standards, this website does not respond to “Do Not Track” consumer browser settings.

2.  Where We Store Your Information

We may collect and store personal information locally on your device or within your web browser application.  We also may store such information on our databases.

We are a nonprofit organization incorporated in California.  We have networks, databases, servers, systems, and support located in the United States.

3.  Retention of Your Personal Information

We will retain your personal information for as long as we reasonably require it for legal or business purposes, including, without limitation, to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, or enforce our Terms or other agreements.  This period will be determined on the basis of applicable legal requirements and business purposes.  When such periods end or we no longer need your personal information, we will securely delete or destroy it.

4.  How We Use Your Information

We use information that we collect about you or that you provide to us, including, without limitation, any personal information, for the following purposes:

·       To Operate Our Organization and Provide You With the Services.  We use the information we collect from you and that you provide us to make our Services and its contents available to you.  This allows us to: (a) send and receive Communications; (b) help you connect with other users by analyzing your Worthy Mentor/Worthy Mentee application form and recommending meaningful connections; (c) improve our Services and develop new ones; and (d) fulfill any other purpose for which you provide such information.

·       To enforce our Terms or other policies.

·       To verify your identity, prevent, investigate, or take action against illegal activity, suspected illegal activity, fraud, or suspected fraud, and to otherwise provide for the safety and security of us and our users (such as in connection with screenings that we perform on Worthy Mentor applicants).  Please note that we conduct a due diligence process on any and all prospective Worthy Mentors.  More information about the Worthy Mentor process can be found in our Terms, and the exact standards we review to approve/reject a Worthy Mentor can be found here.

·       To Mitigate Risk and Maintain Security.  We may use your personal information for risk mitigation and security purposes, including, without limitation, to maintain the privacy and security of our data, to conduct internal audits or investigations, for data security testing and business continuity planning purposes, and to ensure the safety and security of our business.

·       Legal Proceedings and Requirements or Fulfilling Contractual Obligations.  We may use personal information to investigate or address claims or disputes relating to use of the Services, to comply with applicable laws, regulations, or operating licenses or agreements, or pursuant to legal process or governmental request, including, without limitation, from law enforcement. We may also aggregate, anonymize, or otherwise use your personal information without identifying you for any purpose permitted by applicable law.

·       Other uses.  Other uses may include:

o   To facilitate networking opportunities through our Services.

o   To carry out research and analysis to help us improve the Services.

o   To block accounts as part of our anti-spam procedure.

o   To facilitate discussions with our potential investors or donors.

o   To market our Services to our users.

o   To evaluate job applicants.

·       Where We Have Your Consent.  We may use the information we collect from you and that you provide us for any other purpose with your consent (such as in connection with sending you promotional or advertising materials), which can be withdrawn at any time by contacting us at help@worthymentoring.org.

5.  Disclosure of Your Information

We may disclose personal information that we collect from or about you as follows:

·       To Other Users.  When we determine that a Worthy Mentor or Worthy Mentee is a good match based on the information you’ve provided us about you, we may disclose your information to your match as a first step in fostering a meaningful connection.

·       To Professional Service Providers.  We may disclose personal information to consultants, lawyers, accountants, and other professional service providers.

·     To Third Parties.  We may provide your information to other third parties, such as marketing partners and marketing platform providers, contractors, vendors (including, without limitation, providers of certain screening services), service providers, payment processors and facilitators, Google Analytics or a similar service to help us analyze how users use our Website, other trusted third parties to support our organization and perform services on our behalf, and otherwise other third parties with your consent.

·       Within Our Organization.  We may disclose your information to our subsidiaries and affiliates to provide you with the Services.

·       In Connection with a Business Transaction.  We may share your information, including, without limitation, personal information, to a buyer or other successor in connection with, or during negotiations of, an acquisition, merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, or in the unlikely event of a bankruptcy.

·       As Required by Applicable Law.  We may share your information if we believe it’s required by applicable law, regulation, operating license or agreement, legal process or government request, or where the disclosure is otherwise appropriate due to safety or similar concerns.

6.  Opt-Out from Communications

As explained above, we may use your e-mail address or other personal information to send you Communications, including, without limitation, promotional materials.  You can opt-out of receiving promotional Communications by following links provided in the messages, by updating your account preferences through the Services, or by contacting us directly at help@worthymentoring.org.  Although your request to stop receiving information will be reflected promptly in our database, we may retain all information you submit for a variety of purposes, including, without limitation, backups and archiving, prevention of fraud and abuse, and analytics or statistics about our users.  To make a request related to your personal information or otherwise exercise your rights, you may contact us using the contact information provided below. In order to fulfill your request, we may require additional information from you.  You may decline to share certain information with us, in which case we may not be able to provide you with our Services.

7.  Notice to California Residents

California Civil Code Section § 1798.83 permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.  To make such a request, please send an email to help@worthymentoring.org.  Please note that limiting disclosure in certain instances may result in us no longer being able to provide certain Services.

8.  Data Security

We take security seriously and strive to implement and maintain reasonable and appropriate technical and organizational measures designed to protect the confidentiality, integrity, and security of your personal information.  The transmission of information via the internet is not completely secure and no security measures are perfect or impenetrable.  Although we work hard to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services.  Any transmission of personal information is at your own risk.  We are not responsible for circumvention of any privacy settings or security measures contained in our Services.  If you reside outside the United States, please note the personal information we collect about you may not be subject to the same level of protection of personal information as it would be in the jurisdiction in which you reside.  You may contact us using the contact information provided below to learn more about the safeguards that apply to your personal information and to request a copy of such safeguards.

9.  Age Restrictions

To use the Services, we require users to be at least 18 years of age.  If you are not 18 years of age, please do not use the Services, and instead refer to the alternative resources for mentorship and support noted on the Website.  We do not knowingly collect information from persons under 18 years of age.  If we learn that information has been collected through the Services from children under 13 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information.  If you are a parent or guardian and discover that your child under 13 years of age has provided us with personal information without your consent, please contact us using the contact information below to request that we delete the information from our systems.

10.  Territory Restrictions

We operate in the United States, and any personal information collected pursuant to this Privacy Policy may be accessed from and/or stored by us, or those acting on our behalf, in the United States. If you use our Services from outside the United States, you acknowledge that your personal information may be transferred to or accessed from the United States, and consent to such transfer or access.
